Thank you for using boatUnity! BoatUnity Inc. (“BoatUnity,” “we”/”us”) is committed to protecting your privacy. We make the website, https://www.boatUnity.com/ (the “Website”) available together with our services as further described in our Terms of Use (the “Services”). This Privacy Policy describes how we collect, use, process, and disclose your personal information, in conjunction with your access to and use of the boatUnity Platform and the Payment Services.
1.1 Consent:
By using the Website or our Services you consent to the use of your Personal Information as described in this Privacy Policy. Except as set forth in this Privacy Policy, your Personal Information will not be used for any other purpose without your consent. We will not actively collect Personal Information for the purpose of sale or marketing in a way that specifically identifies the individual. In other words, we don’t sell customer lists. You may withdraw your consent to our processing of your Personal Information at any time. However, withdrawing consent may result in your inability to continue using the Website and/or the Services.
2. INFORMATION WE COLLECT
We aim to collect, use and disclose only such information as is required to enable us to manage your account, to provide the Services, to maintain our customer/visitor lists, to respond to your inquiries or provide feedback, for identification and authentication purposes, for service improvement, to process payments, and for insurance purposes. We will maintain the confidentiality of any contact information you provide to us on signing up for our Services or contacting us with questions or for further information and we will use it only for the purposes for which we have collected it (subject to the exclusions and disclosures we have listed below), unless you agree that we may disclose it to other third parties.
There are two general categories of information we collect : The personal information and the non-personnal information.
2.1 Personnal Information
2.1.1 Information you give to us in order to enjoy all the functionalities of the boatUnity Platform.
We ask for and collect the following personal information about you when you use the boatUnity Platform. This information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.
Account Information : When you sign up for an boatUnity Account, we require certain information such as your first name, last name, email address, and date of birth.
Profile and Listing Information : To use certain features of the boatUnity Platform (such as booking or creating a Listing), we may ask you to provide additional information, which may include your address, phone number, and a profile picture.
Identity Verification Information and yachting CV vérification : To help create and maintain a trusted environment, we may collect identity verification information (such as images of your government issued ID, passport, national ID card, or boat license, as permitted by applicable laws) or other authentication information.
Payment Information : To use certain features of the boatUnity Platform (such as booking or creating a Listing), we may require you to provide certain financial information (like your bank account or credit card information) in order to facilitate the processing of payments.
Communications with boatUnity and other Members : When you communicate with boatUnity or use the boatUnity Platform to communicate with other Members, we collect information about your communication and any information you choose to provide.
Your Reviews : If someone has written a reference for you, it will be published on your boatUnity public profile page with your consent.
2.1.2 Optional, information you choose to give us.
You may choose to provide us with additional personal information in order to obtain a better user experience when using boatUnity Platform. This additional information will be processed based on our legitimate interest or when applicable, your consent.
Additional Profile Information : You may choose to provide additional information as part of your boatUnity profile (such as gender, preferred language(s), city, and a personal description). Some of this information as indicated in your Account settings is part of your public profile page, and will be publicly visible to others.
Address Book Contact Information : You may choose to import your address book contacts or enter your contacts’ information manually to access certain features of the boatUnity Platform, like inviting them to use boatUnity.
Other Information : You may otherwise choose to provide us information when you fill in a form, update or add information to your boatUnity Account, respond to surveys, post to community forums, participate in promotions, communicate with our customer care team, share your experience with us (for example through your social medias), or use other features of the boatUnity Platform.
2.1.3 Information that is necessary for the use of the Payment Services.
In order to use our Services, Renters and Owners are required to enter certain payment information. The information required varies depending on the type of user and their preferences:
Deposits and Rental Fees: Deposits and Rental Fees paid by the Renter can only be made through our payment processors, Paypal and/or Stripe. Any payments made through Paypal and/or Stripe are secure, and the Renter’s Paypal and/or Stripe payment information and credentials are not stored on our servers.
Remittances: Remittances to Owners are paid out by BoatUnity via Paypal and/or Stripe. All information collected in this way, will not be disclosed to anyone, except as outlined below in Important Exceptions.
Refunds: Cancellation refunds to Renters are also made through Paypal and/or Stripe refunded back onto the credit card on which the Booking was paid by the Renter.
2.1.4 Information We Collect from Third Parties.
boatUnity and boatUnity Payments may collect information, including personal information, that others provide about you when they use the boatUnity Platform and the Payment Services, or obtain information from other sources and combine that with information we collect through the boatUnity Platform and the Payment Services. We do not control, supervise or respond for how the third parties providing your information process your Personal Information, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.
Third Party Services : If you link, connect, or login to your boatUnity Account with a third party service (e.g. Google, Facebook, WeChat), the third party service may send us information such as your registration, friends list, and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
2.2 Non-Personal Information
Non-Personal Information means data in a form that does not permit direct association with any specific individual. The following are some examples of non-personal information that we may collect and how we may use it:
System Logs & Cookies: Cookies are used by us to track content usage and traffic on the Website. A cookie is a feature of your web browser that consists of a text file that is placed on your hard disk by a web server. The Website uses cookies to help it compile aggregate statistics about usage of this Website, such as how many users visit the Website, how long users spend viewing the Website, and what pages are viewed most often. This information is used to improve the content of the Website. You can set your browser to notify you when you are sent a cookie. This gives you the chance to decide whether or not to accept it. If you disable cookies, you may not be able to take advantage of all the features of the Website. We do not link any of the information we use in cookies to any personally identifiable information submitted by you when you are on the Website.
Your IP address is reported by your web browser whenever you visit a page on the Website. This information is recorded together with your registration information on our databases. Our website uses Google Analytics to help us learn about who visits our site and what pages are being looked at. All information collected through these means is non-personal, aggregate information, and is not linked to your Personal Information.
2.3 Children’s Data.
The Website and our Services are intended for use by individuals aged twenty-one (21) and older. By using this Website, you represent that you are at least twenty-one (21) years of age. Consequently, we do not knowingly collect personally identifiable information from individuals under the age of 13. If a parent or guardian becomes aware that his or her child under the age of 13 has provided us with Personal Information without their consent, he or she should contact us at hello@BoatUnity.com. If we become aware that an individual under 13 has provided us with any Personal Information, we will take steps to delete such information.
3. HOW WE USE INFORMATION WE COLLECT
We may use, store, and process personal information to :
- enable you to access and use the boatUnity Platform,
- enable you to communicate with other Members. As part of our Services we make a messaging system available so that our users can contact one another and organize transactions. Using the messaging system will not give other users access to your email address. We also require Owners and Renters to rate and review one another when a transaction has been completed. Any Personal Information that you give out through these means is outside of our control and is your responsibility. If another user gives out your Personal Information in a review, or you would like a review taken down for any other reason, please contact contact@boatUnity.com and we will work with you to resolve the issue.
- send you service or support messages, updates, security alerts, and account notifications
- detect and prevent fraud, spam, abuse, security incidents, and other harmful activity,
- conduct security investigations and risk assessments
- verify or authenticate information or identifications provided by you (such as to verify your address or compare your identification photo to another photo you provide)
- conduct checks against databases and other information sources, including background or police checks, to the extent permitted by applicable laws and with your consent where required
- comply with our legal obligations
- Resolve any disputes with any of our Members and enforce our agreements with third parties
- enforce our General Term and condition of use in connection with the activities above, we may conduct profiling based on your interactions with the boatUnity Platform, your profile information and other content you submit to the boatUnity Platform, and information obtained from third parties. In limited cases, automated processes may restrict or suspend access to the boatUnity Platform if such processes detect activity that we think poses a safety or other risk to the boatUnity Platform, our community, or third parties. - Provide, Personalize, Measure, and Improve our Advertising and Marketing. If you opt-in to receive marketing communications from us, we will keep you up to date on our products and services through our Newsletter. You may withdraw your consent to receiving marketing communications from us at any time by following the “unsubscribe” instructions in each communication.

- to operate, protect, improve, and optimize the boatUnity Platform and experience, and personalize and customize your experience (such as making Listing suggestions, ranking search results
4. SHARING & DISCLOSURE
4.1 Advertising, Social Media and blog
Our social media pages and our blog provide the opportunity to post content in a public area. If you decide to submit information on these pages, you agree that these information, including personnal information may be publicly available.
The social media platforms with which we may share your personal information are not controlled or supervised by boatUnity. Therefore, any questions regarding how your social media platform service provider processes your personal information should be directed to such provider.

4.2 Sharing between Members.
In order to facilitate the booking process between 2 members, boatUnity may need to share some information, uncluding personnal information such as your profile détails, your booking and/or cancellation history on our plateform.
When a booking is confirmed, additionnal required personnal information may be disclosed to the 2 members inlvolved in the booking agreement to assist with coordinating the trip. They can include the phone number, the boat adress or adress where the Renter will board on your boat. The billing and payout information are not shared with other Members.
4.3 Profiles, Listings, and other Public Information.
You alone decide what information will be public on your profile and your listing. Your listing may include the description and the approximative location of your boat and your profile page may include your name and public photos. By filling up these information you agree to disclose them publicly both on our plateform and on the search engines indexation. We don’t have any control on the search engine algorithmes and methodology whom can use caches memories containing your information.
At the end of a booking, the members can evaluate each other. The evaluation given is part of the public profile of the member and may appear in other pages of the boatUnity plateform, such as the listing page. Any content posted on our blog or our social media may also be disclosed publicly.
By extension, if a partner uses widget and/or an Api to display boatUnity’s listings, the information of your listing and public profile can be displayed on a third party website.
4.4 Third Party Partners.
The boatUnity Platform may contain links to third party websites or services, such as Google Maps, including the Google Maps API(s). We don’t have any sort of control upon the way they collect and mange the personal information. We invite you to read their Privacy Policy for more information.
Service Providers: If may happen time to time that we employ third parties to help us improve the Website and/or the Services, conduct surveys, collect and process payments, provide technical support, provide member support, provide boat insurance and administer claims, and assist in the processing of memberships . These third parties may have limited access to databases of user information solely for the purpose of helping us to improve the Website and/or the Services and they will be subject to contractual restrictions prohibiting them from using the information about our members for any other purpose.
Partner Promotion: We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third party partner the information that you provide will be shared with us and with them. Their use of your information is not governed by this privacy policy.
4.5 Important Exceptions.
We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Website members, other users of the Services, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law.

corporate re-organization, a merger or amalgamation with another entity, a sale

We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service.

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you.
